There is a persistent rumor from dentists that covenants not to complete are not enforceable. In Texas this is false. Covenants not to compete merely need to be “reasonable in time and geography” and only as broad as necessary to “protect the interests of the dental practice owner.”  Of course what is reasonable varies from dental practice to practice and location to location. But in general we believe that a time period of 3 years and a distance of 5 to 15 miles is easily enforceable. When drafting agreements (associate agreement or purchase agreement) make sure you have an attorney that is experienced and knowledgeable in this area.
